We persuaded the SORB to terminate registration for our elderly client, who had been convicted of indecent assault and battery on a child more than 25 years ago. This client was previously listed publicly on the internet for 13 years as a Level 3 when his prior lawyer failed to timely request a hearing. We vacated the Level 3 in 2016, reinstated his hearing rights, and after a hearing he received a Level 1 in 2018, removing him from the public website. In 2023, after litigating a further motion for termination, the client was deemed “no cognizable risk” based on his age, rehabilitation, and offense-free time in the community. He will no longer have to register at all.
