Our client was convicted out-of-state for an offense that is not a crime in Massachusetts due to a difference in the age of consent. He was sent to Massachusetts under the Interstate Compact for Adult Offender Supervision (ICAOS) to serve out his probationary term. He was initially ordered to register as a sex offender and was placed on an electronic monitoring device as a sex offender on probation. We persuaded the SORB and the Office of the Commissioner of Probation that our client does not qualify as a “sex offender” for Massachusetts purposes. He was relieved of the obligation to register with the SORB and the electronic monitoring device was removed from his person.
