After reviewing the brief submitted to the Massachusetts Appeals Court that we submitted on behalf of our client appealing convictions for assault and battery, the Commonwealth agreed that our client was entitled to a new trial as a result of prosecutorial misconduct in closing argument. Upon assented-to motion, the Plymouth District Court subsequently granted our client a new trial on those charges.
